Terms & Conditions
By purchasing and ordering goods and products from Glebe Farm Hedging Ltd via this website (www.glebefarmhedging.co.uk) or by any other means, you enter a legally binding agreement. Please read these terms because they affect your rights. These terms describe the basis for purchase by you and sale by us of the products described on this website.
Definitions and interpretation.
In these terms the following words have the following meanings:
the contract for the sale and purchase of plants, products or services.
the transportation of plants or products specified on your order from our premises to your specified address, by our own vehicles or those of a third party carrier.
the range of plants, trees, products and services which are available for purchase from our website in accordance with the terms.
“Us” or “We” refers to Glebe Farm Hedging Ltd whose registered office is at Glebe Farm, Langham, Colchester, Essex, UK, CO4 5PP.

Basis of the sale
An agreement for us to sell you goods (a contract) is made on these terms when we accept an order made by you via our website. The description of the goods, the price, VAT, and delivery costs are set out in the order page. We will confirm acceptance of your order by email.
We endeavour to give accurate descriptions of the plants and goods we sell. Size ranges given show the minimum size we would expect to supply, however sizes quoted should be regarded as approximations.
Images, descriptions and other information regarding particular plants or products are for guidance only.
All plants are measured from soil level upwards to the tip of the plant.
The quantity, size and selection of the goods will be those set out in your order (if accepted by us).
We will only send substitutions if they are agreed by you.
Orders are accepted at our sole discretion and subject to availability.
Prices quoted may be subject to change without notice. In exceptional circumstances, if the price of the goods increases or decreases between the date we accept your order and the delivery date, we will let you know and ask you to confirm that the new price is acceptable. If it is not acceptable then you will have the option to cancel the order.
All prices quoted are inclusive of VAT at the prevailing rate (currently 20%) where applicable.
All prices are quoted in GB pounds sterling.
Our charges for delivery and packaging are detailed on the order page and will be included in the total price.
Payment is required with order.
When ordering through this website, payments are taken via a 3rd party Payment Gateway (Worldpay Ltd) on their secure site. Payment does not guarantee our acceptance of your order.
No order will be accepted by us until after full cleared payment has been received in our account.
We can also accept orders by post with payment by cheque, over the telephone with card payment, or in person by cheque, cash or card. If you wish to pay by bank transfer, please ring your order through and we will give you our bank details.
If it is not possible to obtain full payment for the goods from your account prior to despatch we may cancel or postpone the order. This does not affect any other rights we may have.
Risk and Ownership
Risk of damage to or loss of the goods passes to you at the time of delivery or, if you fail to take delivery, at the time agreed for delivery.
Ownership of the goods only passes to you once they have been successfully delivered or collected and when we have received cleared payment in full.
Orders are despatched as soon as possible after receipt of orders on a pre-arranged date to suit you. In season, normal lead times are 4-10 days, but may be longer at our busiest times (November and March). Most orders are sent with our contract carrier (APC) on a next day service and are delivered on weekdays (Tuesday-Friday). For delivery to all UK mainland destinations (excluding larger ‘mature’ hedge plants and special items) the charge for this service is £9.95 per order, regardless of volume or quantity, but subject to a minimum order value of £20 + delivery cost. Saturday and timed deliveries can be arranged at extra cost, subject to acceptance and confirmation by us.
If delivery is required to Northern Ireland, The Channel Islands, The Isle of Wight, The Isle of Man, Orkneys, Shetlands, Hebrides or any other offshore destinations please contact us for a quote.
If you wish to order ‘mature’ hedge plants or special items, please contact us for a delivery quote.
We will deliver the goods to the address you specify for delivery in your order. It is important that the address details you give us are accurate. Most orders do not need to be signed for, but please be precise about where you would like the goods left if you are out at the time of delivery. We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions.
We will aim to deliver on a specific agreed date but delivery times are not guaranteed.
If we are aware that a delivery is or may be delayed due to any cause beyond our reasonable control, we will contact you with a revised schedule.
Please advise us within 24 hours if your delivery has not arrived on the date specified.
Collection of Orders
Local customers are welcome to come and collect pre-booked orders, by prior arrangement. We do not normally have bare root plants available to collect on a ‘cash and carry’ basis. All plants are lifted, graded and packed to order, so please give us at least 4-10 days notice if you intend to collect. Minimum order value £10. Normal Office hours: Mon-Fri 9.00 – 5.00, Sat 9.00 – Midday (closed on Sundays).
Cancellations and Refunds
We understand that occasionally orders may need to be cancelled for personal reasons or reasons beyond your control.
All cancellations must be notified to us by email or fax within the time frames indicated. We will endeavour to respond within 2 working days.
Non-plant products: Orders for non-plant products can be cancelled at any time up to 7 working days from the day after receipt of delivery. These goods must be returned to us in their original packaging and in a re-saleable condition within 30 days of your notice of cancellation. If these conditions are met, we will refund the purchase price of those items returned, less any costs incurred by us to recover those items, if applicable.
Plants and Trees: Under section 13, 1, (c) of The Consumer Protection (Distance Selling) Regulations 2000, owing to their perishable nature, we reserve the right to refuse returns or refunds on any live plants after delivery has been accepted, unless those plants can be proved defective in their quality or condition at the time of receipt or not as ordered or as described.
Pot Grown Plants: Orders for any listed pot grown plants can be cancelled at any time between our receipt of your order and 8am on the day of despatch (ie 1 day before agreed delivery date) and will be subject to a full refund of the purchase price of those items. Orders cancelled after despatch, but prior to delivery at your address, will be subject to a full refund less any costs incurred by us in connection with delivery/recovery.
Bare root plants, rootballed plants and special order plants: Orders for any listed bare root plants or rootballed plants or non-listed special order plants cancelled within 48 hours of our acceptance and confirmation of your order will be subject to a full refund of the purchase price of cancelled items. All bare root and rootballed plants are lifted to order and owing to their nature, their perishable qualities and the logistics of preparation, orders cannot be cancelled after the order has been lifted and graded. Under normal circumstances, we may agree to a partial and fair refund, depending on what stage the order has reached and the nature of the order, at our sole discretion. However, we reserve the right, in exceptional circumstances, to retain up to the full order value less any delivery costs paid.
If any order or part order of live plants is found to be defective, or not as ordered or as described, you must advise us by email or fax within 3 days of receipt. Where necessary, we will arrange for collection of those plants at our cost. Returns must be adequately re-packed for transport, and upon receipt we will assess their condition and offer a refund up to the full value paid, or offer replacement plants to be delivered at the earliest possible date.
Card refunds can only be paid to the card account used for the purchase of the goods.
Any order or part thereof that we are unable to supply for reasons of availability or reasons beyond our control will be refunded in full within 30 days of the order being received by us, if substitutions cannot be agreed.
If any pot grown plant should die of natural causes and you inform us up to one year after they have been received by you, or in the case of bare root or rootballed plants, if they die of natural causes and you inform us before 31st October following receipt, we will replace with like for like free of charge (we may make a charge for delivery at our discretion). If plants of the type and size ordered are not available within 8 months of notification of failure, we will offer substitutes or a refund to the value paid for those plants which have failed.
Please advise us by email, fax or post as soon as you become aware of failures. In addition we may require images of the plant(s) and planting location, in order to assess the reasons for failure.
We will not replace plants that have failed due to neglect, physical or chemical damage, or adverse soil conditions. This does not affect your statutory rights.

Governing law and jurisdiction: these terms are governed by English law and any disputes will be resolved exclusively by the English Courts.
